POTB Facebook Terms of Use

The POTB Facebook application is intended to provide a place for fans of Planet Fitness to create and share a Pat On the Back ("POTB"). All comments, visuals, videos and other type of material posted by fans on this site ("User Content") do not necessarily reflect the opinions or ideals of the Planet Fitness ("PF") corporation, its employees or affiliates. PF (a) does not represent or warrant the accuracy of any statement or product claims made here, (b) is not responsible for any User Content on this site, and (c) does not endorse any opinions expressed on this page.

All users must comply with Facebook's Terms of Use and Planet Fitness Terms of Use for the POTB Application Page. PF does not monitor every posting of User Content on the POTB Application Page. PF expects, however, that users will not post any materials that fall into any of the following categories and may have removed any materials that:

1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
2. Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent, misleading or unlawful material or information.
3. Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
4. Upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
5. Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.
6. Falsify the origin or source of software or other material contained in a file that is uploaded.

Use of POTB Content/Publicity. By submitting POTB Content, the POTBer hereby expressly grants to the Sponsor an irrevocable, royalty-free, worldwide license in perpetuity to reproduce, distribute, adapt, modify, publicly perform, and display the entry, and otherwise use and exploit all or any part of the Content by any method (now existing or later developed) for any purpose whatsoever including, but not limited to hosting and displaying the POTB Content on Sponsor’s websites in conjunction with the promotion of Sponsor’s products. POTBer hereby grants to the Sponsor an irrevocable, royalty-free, worldwide license in perpetuity to use competitor’s rights of publicity in connection with the POTB Content for any purpose whatsoever including but not limited to the campaign and related activities. POTBer also grants to the Sponsor a license to use his or her name to identify the source of the POTB Content. Further, if a third party's rights of publicity appear in the POTB Content, POTBer represents and warrants to the Sponsor that s/he has secured and hereby grants to the Sponsor a license to use such third party's rights of publicity to the same extent as his or her own rights of publicity. POTBer shall indemnify, defend and hold harmless the Sponsor from any and all claims, demands, causes of action or damages, costs and expenses (including attorneys' fees) brought against the Sponsor based upon the Sponsor’s use of the entry and any proprietary rights embodied therein. POTBer hereby waives, releases and discharges any and all claims whatsoever against the Sponsor for its use of the POTB Content (including, but not limited to any alleged or actual infringement or misappropriation of any proprietary rights in any information contained in the POTB Content submitted to the Sponsor). All POTB Content sent to the Sponsor will be treated as non-confidential and non-proprietary. POTBer agrees that the Sponsor is not required to use the information contained in the POTB Content in any manner and that if the Sponsor uses POTB Content, the Sponsor may remove a portion of or the entire POTB Content at any time without notice to competitor.
